Terms and Conditions of Service

Please read these Terms and Conditions carefully before subscribing to Fortress Workspace. By subscribing or using the Service, you agree to be bound by these Terms. If you do not agree, do not subscribe or use the Service.

1.  About Fortress Workspace

Fortress Workspace is a mobile security subscription service operated by Fortress Technical Solutions Inc. (“Fortress,” “we,” “us,” or “our”), a corporation registered in Canada. The Service creates a secure, encrypted business environment on your existing personal mobile device using mobile device management (MDM) technology and a per-app VPN, while keeping your personal apps, photos, contacts, and data completely separate and untouched.

These Terms govern your access to and use of Fortress Workspace as an individual subscriber (“you” or “your”). They do not apply to corporate or enterprise engagements, which are governed by a separate agreement.

 

2.  Subscription Plans and Pricing
2.1  Available Plans

Fortress Workspace is offered on the following subscription plans:

  • Monthly Plan: $28.00 CAD per month, billed monthly

  • Annual Plan: $288.00 CAD per year, billed annually (a saving of $48.00 compared to the monthly rate)

All prices are in Canadian dollars and are inclusive of applicable taxes where required by law. We reserve the right to change our pricing at any time with at least 30 days’ written notice to you.

2.2  Billing

Your subscription begins on the date you complete your purchase. You will be billed automatically at the start of each billing period (monthly or annually, depending on your chosen plan) using the payment method you provided at checkout. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

2.3  Failed Payments

If a payment fails, we will attempt to notify you by email. If payment is not received within 7 days of the due date, we may suspend your access to the Service until your account is brought current.

 

3.  Cancellation and Refunds
3.1  Cancellation

You may cancel your subscription at any time through your account portal at fortressworkspace.ca/my-subscriptions or by contacting us at support@fortresstechsolutions.ca. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until that date.

3.2  No Partial Refunds

We do not offer partial refunds for unused time within a billing period. If you cancel a monthly plan mid-month or an annual plan mid-year, your access continues until the end of the paid period and no refund is issued for the remaining time.

3.3  30-Day Satisfaction Policy

If you are not satisfied with Fortress Workspace within the first 30 days of your initial subscription, contact us at support@fortresstechsolutions.ca and we will work with you to resolve the issue or provide a full refund at our discretion. This policy applies to your first subscription period only.

 

4.  The Service — What We Provide

Your Fortress Workspace subscription includes:

  • Mobile device management (MDM) enrollment on your iOS or Android device

  • Per-app VPN protection using Cloudflare WARP, automatically active for your managed business apps

  • Managed business apps including Chrome and Outlook, pushed automatically to your device

  • Setup guides and onboarding support via email

  • Ongoing technical support via support@fortresstechsolutions.ca

The Service is designed for use on one personal device per subscription. If you wish to use Fortress Workspace on more than one device, an additional subscription is required for each device.

 

5.  Your Responsibilities

By subscribing to Fortress Workspace, you agree to:

  • Provide accurate information when creating your account and completing your subscription

  • Keep your login credentials confidential and not share access to your account

  • Use the Service only for lawful business purposes and in compliance with applicable laws

  • Not attempt to circumvent, disable, or tamper with any security controls, MDM policies, or VPN configurations installed by the Service

  • Promptly notify us at support@fortresstechsolutions.ca if you become aware of any unauthorized use of your account

You are responsible for maintaining a compatible device and operating system. Fortress Workspace requires iOS 16 or above, or Android 10 or above. We are not responsible for any incompatibility arising from operating system updates made after your enrollment.

 

6.  Privacy and Your Personal Data
6.1  What We Can and Cannot See

Fortress Workspace is designed to protect your business information, not monitor your personal life. Our MDM technology manages only the business environment created on your device. We do not have access to your personal photos, personal messages, personal email accounts, personal contacts, personal browsing activity, or personal apps.

6.2  What We Do Collect

In connection with providing the Service, we may collect and process:

  • Your name, email address, and billing information when you subscribe

  • Device identifiers and enrollment status for the purpose of managing your MDM profile

  • VPN connection data (such as connection times and data volumes) processed through Cloudflare WARP for security and service delivery purposes

  • Support communications you send to us

6.3  Canadian Privacy Law

Fortress Technical Solutions Inc. complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. We collect, use, and disclose your personal information only for the purposes described in these Terms and our Privacy Policy, available at fortressworkspace.ca. You may contact us at support@fortresstechsolutions.ca to access, correct, or request deletion of your personal information.

6.4  Third-Party Services

The Service relies on third-party platforms including Cloudflare (VPN), Mosyle (iOS MDM), and Samsung Knox Manage (Android MDM). These providers process certain technical data as part of delivering the Service. We take reasonable steps to ensure these providers maintain appropriate security standards, but their services are governed by their own terms and privacy policies.

 

7.  Intellectual Property

Fortress Workspace, the Fortress Workspace name and logo, and all related materials are the intellectual property of Fortress Technical Solutions Inc. Nothing in these Terms grants you any ownership interest or license in our intellectual property beyond the limited right to use the Service as described herein.

You retain all ownership of your personal data and any business data you store or access through apps managed by the Service.

 

8.  Warranties and Disclaimers

We warrant that we will deliver the Service in a professional manner using commercially reasonable efforts, and that the Service will function materially as described at fortressworkspace.ca.

Except as expressly stated above, the Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities. Mobile security is a rapidly evolving field and no security solution provides absolute protection.

We are not responsible for interruptions or degradation of the Service caused by factors outside our control, including but not limited to internet connectivity issues, device malfunctions, operating system updates, third-party service outages (including Cloudflare, Apple, or Google), or cyber incidents affecting third-party infrastructure.

 

9.  Limitation of Liability

To the fullest extent permitted by applicable Canadian law, our total liability to you for any claim arising out of or relating to the Service will not exceed the total subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of business, or loss of profits, even if we have been advised of the possibility of such damages.

We are not liable for any loss, damage, or security breach arising from your tampering with, circumventing, or disabling any security controls, MDM policies, or VPN configurations installed by the Service.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, to the extent such limitations are prohibited by applicable law.

 

10.  Termination by Us

We may suspend or terminate your access to the Service immediately and without notice if:

  • You materially breach these Terms and fail to remedy the breach within 7 days of written notice from us

  • We have reasonable grounds to believe your use of the Service is unlawful or poses a risk to other users or third parties

  • You engage in abusive, threatening, or harassing conduct toward our staff

If we terminate your account for reasons other than breach or misconduct, we will provide a pro-rated refund for the unused portion of your current billing period.

 

11.  What Happens When You Cancel or Leave

When your subscription ends (whether by cancellation, non-renewal, or termination):

  • Your MDM profile will be removed from your device

  • Managed app configurations, including the VPN settings, will be removed

  • Business apps installed by the Service may remain on your device, but will no longer be managed or VPN-protected

  • Your business data remains in the cloud services you used (such as Outlook or OneDrive) and is accessible via your own credentials

We do not delete your personal data immediately upon cancellation. We retain your account and billing records as required by applicable law and our data retention policy. You may request deletion of your personal information by contacting support@fortresstechsolutions.ca.

 

12.  Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you may cancel your subscription before the changes take effect.

 

13.  Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.

If you have a complaint or dispute, we encourage you to contact us first at support@fortresstechsolutions.ca. We are committed to resolving disputes fairly and promptly. If we cannot resolve a dispute informally, it will be subject to the exclusive jurisdiction of the courts of Ontario.

 

14.  General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fortress Technical Solutions Inc. regarding your use of Fortress Workspace. They supersede any prior communications, representations, or agreements relating to the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign your subscription or any rights under these Terms to any other person without our prior written consent.
